Passenger injury compensation - know your rights

Being injured in a road accident can be a stressful time, particularly if it was caused by someone else's negligence. Your injuries might mean you have to take time off work to recover, as well as making everyday life more difficult. Claiming passenger injury compensation can help you get back on your feet financially.

Passengers travelling in vehicles are sometimes forgotten about in car accident claims, but we don't think this should be the case. If you're a passenger in a vehicle or public transport and you've received injuries after an accident, you could be eligible for passenger injury compensation, even if the person driving the vehicle you were in was responsible for the accident.

Typical injuries that lead to passenger injury compensation

Passengers, much like drivers themselves, can suffer significant or lasting injuries in road accidents, including:

  • Whiplash injuries and concussion
  • Broken or fractured bones
  • Soft tissue injuries
  • Ligament and tendon damage
  • Nerve damage

The car I was a passenger in was responsible for the accident, can I claim?

You can still claim if you receive injuries and the driver of the car you were a passenger in was responsible for the accident.

In any passenger accident compensation claim the compensation is paid out by the insurance company of the driver responsible for the accident. For example, if your friend or family member was driving and caused an accident in which you received whiplash, any compensation awarded would be paid by your friend or family member's insurance company.

Passenger injury compensation - what if the driver has no insurance?

If the driver who caused the accident has no insurance, you could still be able to claim. In this case the Motor Insurers' Bureau will pay your compensation if your passenger injury compensation claim is successful.

Accidents involving bus passengers

If you were injured while travelling as a passenger on a bus, you could be eligible to make a no win no fee passenger injury compensation claim.

For example, if you're injured as a result of unsafe driving on the part of the bus driver, you may be entitled to compensation.
